Kane County Divorce: After Filing, What are the Next Steps?

It’s the new year, and a client with a new case just filed emails me to understand what the next steps are in his/her case. Even though the case may feel brand new to a new litigant, financial disclosure comes up quickly. Illinois divorces typically require a Financial Affidavit, which details income, expenses, assets, and debts.

Encourage readers to start gathering:

  • Pay stubs and tax returns
  • Bank and retirement statements
  • Credit card and loan balances

Having this information ready early can save time, money, and frustration later.


5. If Children Are Involved, Expect Extra Early Requirements

For divorces involving minor children, Illinois courts require additional steps early in the case. This may include online or in person parenting education classes (depending on the county of the case….Kane County has an excellent in person program, by way of example) and preparation for a parenting plan addressing decision‑making and parenting time.

Many courts will not finalize a divorce with children until these requirements are completed, so it helps to start early rather than wait until the end of the case.


6. Understand That “Filing” Is Just the Beginning

Many people assume that filing for divorce means the hardest part is over. In reality, filing opens the door to:

  • Negotiation
  • Temporary hearings
  • Exchange of financial information
  • Court appearances or settlement conferences

 


Final Thoughts

The days immediately after filing a Petition for Dissolution of Marriage are about planning, momentum and organization. Serving the other spouse efficiently, tracking deadlines, and getting paperwork in order can make the rest of the case far smoother.
